Easy Permit Search – Terms of Service

By accessing or using Easy Permit Search ("Service," "Platform," "we," "our," or "us"), you ("User" or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. DESCRIPTION OF SERVICE

Easy Permit Search provides access to building permit information, property ownership data, and related public-record information aggregated from various government sources. The Service may also include tools to filter, search, review, or download such information.

You acknowledge and understand that:

• All data is sourced from public records that may contain errors, omissions, or delays.
• We do not create, modify, validate, or guarantee the accuracy of external data sources.

2. LICENSE TO USE

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your own personal or internal business use.

You may NOT:

• Sell, resell, sublicense, or distribute any data obtained through the Service.
• Share login access or credentials with another person or entity.
• Use the data to create a competing service.
• Scrape, extract, harvest, or download data in bulk unless explicitly permitted.

Any violation will result in immediate termination of your access without refund.

3. DATA USE & COMPLIANCE WITH LAWS

You agree that:

• You will use all data strictly in accordance with all applicable federal, state, and local laws, including privacy, consumer protection, fair housing, telemarketing, and marketing regulations.
• You will comply with all restrictions on outreach (e.g., do-not-call lists, opt-out laws).
• The data may not be used to stalk, harass, discriminate, or engage in any unlawful conduct.
• We do not monitor or control how you use the data; you are solely responsible for your actions.

4. NO WARRANTY / DATA ACCURACY

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

We make NO WARRANTIES, express or implied, including but not limited to:

• Accuracy or completeness of data
• Timeliness or availability of data
• Fitness for a particular purpose
• Continuous or error-free operation

Because our data is sourced from third-party government systems, we do not control or guarantee the accuracy, completeness, or currency of any information presented.

You agree we are not liable for any errors, outdated information, missing data, or consequences of relying on such information.

5. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

• We shall not be liable for any indirect, incidental, punitive, special, or consequential damages (including loss of business, profits, goodwill, or data), even if advised of the possibility of such damages.
• Our total liability for any claim arising out of your use of the Service shall not exceed the amount you paid in the previous 12 months (or $100 if you paid nothing).

You expressly agree that:

• Your use of publicly sourced data is entirely at your own risk.

6. SUBSCRIPTIONS, PAYMENTS & TOKENS

If you purchase a subscription or tokens:

• All fees are non-refundable except where required by law.
• Plans may include usage limits (including token caps).
• Abuse, misuse, or unauthorized data extraction may result in immediate account suspension.
• You authorize us to process payments through our third-party payment providers (e.g., Stripe).

7. USER RESPONSIBILITIES

You agree that you will:

• Provide accurate account information.
• Maintain the confidentiality of login credentials.
• Be responsible for all activity conducted under your account.

You agree not to:

• Attempt to bypass security or access restrictions.
• Reverse-engineer, copy, or derive data through automated means (bots, scrapers, etc.) unless explicitly authorized.
• Upload malicious code.

8. DATA SOURCING & THIRD-PARTY LINKS

The Service integrates information from:

• Government agencies
• Publicly available databases
• Third-party systems

We are not affiliated with, endorsed by, or officially connected to any of these agencies.

We do not guarantee continuous access to external systems or APIs.

9. TERMINATION

We may:

• Suspend or terminate your account at any time for violation of these Terms.
• Terminate or modify any feature, access level, or the entire Service at our discretion.

Upon termination:

• Your right to access the Service and data immediately ceases.
• No refunds will be issued except where required by law.

10. INDEMNIFICATION

You agree to indemnify and hold harmless Easy Permit Search, its owners, employees, contractors, and affiliates from any claims, damages, liabilities, losses, or expenses arising out of:

• Your misuse of the Service
• Your violation of laws
• Your violation of these Terms
• Your use of data obtained through the Service

11. PRIVACY POLICY

Use of the Service is also governed by our Privacy Policy, which outlines how we collect and use data.

12. MODIFICATIONS TO TERMS

We may update these Terms at any time. Continued use after changes constitutes acceptance of the new Terms.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the state of North Carolina, without regard to its conflict-of-law principles.

Any disputes shall be resolved exclusively in the state or federal courts located in New Hanover County, NC.
